Terms of Use

These Terms of Use ("Terms") govern your use of apps published by Apexcode ("we", "us"), including Netly, and any related services such as cloud sync and the Netly web app (together, the "Services"). By downloading, installing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms act as the end user license agreement (EULA) for our apps. Where our apps are distributed through the Apple App Store, the terms in the section "Apple App Store" below also apply.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use our apps on Apple-branded devices that you own or control, for your personal, non-commercial use, in accordance with these Terms and the App Store's usage rules. We (and our licensors) retain all rights, title, and interest in the Services, including all intellectual property rights.

Accounts

Some features, such as cloud sync, partner sharing, and the web app, require an account created with Sign in with Apple. You are responsible for activity that occurs under your account and for keeping access to your Apple ID secure. You must be at least 13 years old (or the minimum age of digital consent in your country) to create an account.

You can delete your account at any time from within the app (Settings → Account). Deleting your account permanently removes your synced data from our servers.

Your Data

You own the financial data you enter into our apps. If you enable cloud sync, you grant us a limited license to store, transmit, and process that data solely to provide the Services to you (for example, syncing it between your devices, the web app, and, if you set it up, a partner you have invited). How we handle your data is described in our Privacy Policy.

You are responsible for maintaining your own backups. We recommend using the app's export feature regularly.

Partner Sharing

Netly lets you share selected assets with one other account that you invite. Only invite people you trust: a partner you link with can see the assets you mark as shared, including their value history, until you unlink. You are responsible for the accuracy of invitations you send.

Subscriptions and Purchases

Some features require a paid subscription ("Netly Pro"). Subscriptions are purchased through Apple and are processed by Apple, not by us.

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your App Store account settings at any time.
• Any free trial converts to a paid subscription unless cancelled before the trial ends.
• Refunds are handled by Apple in accordance with App Store policies.

Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose;
• Attempt to gain unauthorized access to our systems or to data belonging to other users;
• Interfere with or disrupt the operation of the Services;
• Reverse engineer, decompile, or disassemble the apps except to the extent permitted by applicable law;
• Resell, rent, or sublicense the Services.

Not Financial Advice

Our apps are tools for organizing and visualizing information you provide. Nothing in the Services constitutes financial, investment, tax, or legal advice. Market prices and exchange rates are provided by third-party sources, may be delayed or inaccurate, and are provided for informational purposes only. Always verify important figures independently and consult a qualified professional before making financial decisions.

Service Availability and Changes

Cloud-based features depend on servers and third-party infrastructure and may occasionally be unavailable. We may modify, suspend, or discontinue any part of the Services at any time. If we discontinue cloud sync entirely, your local data remains on your device and can be exported.

Termination

We may suspend or terminate your access to the Services if you materially breach these Terms. You may stop using the Services at any time; deleting your account and the app ends the license granted above. Sections concerning your data, disclaimers, limitation of liability, and governing law survive termination.

Disclaimer of Warranties

The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of data loss.

Limitation of Liability

To the maximum extent permitted by applicable law, Apexcode shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or related to your use of the Services. Our total liability for any claim shall not exceed the amount you paid us for the Services in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.

Apple App Store

Where you obtained the app through the Apple App Store, the following applies:

• These Terms are an agreement between you and Apexcode, not Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• In the event the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection claims.
• In the event of a third-party claim that the app infringes intellectual property rights, Apexcode, not Apple, is responsible for the investigation, defense, settlement, and discharge of such claim.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing Law

These Terms are governed by the laws of Denmark, without regard to conflict of law principles. Mandatory consumer protection rules of the country where you live remain unaffected.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and may notify you through our apps. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
